BH-12-FPM, identification number TMAJT81UAEJ625809, type approval no. AFHY1V1911W44E5, cylinder capacity 1685 ccm, of brown colour, manufacture year 2014, for a period of 5 (five) years, i.e. for the period 23rd February 2015 – 23rd February 2020, so that it may be used by the bailee to travel in Romania, as well as Italy and wherever else abroad.----I. BAILER’S OBLIGATIONS: - to hand over the motor car to the bailee, on the date and in the conditions agreed upon;---- not to disturb the use of the motor car by the bailee, giving him a guarantee against the possible hidden defects of the motor car.-------------------------------------------------------------------II. BAILEE’S OBLIGATIONS: - to guard and preserve the borrowed motor car with the caution and diligence of a good owner; ------------------------------------------------------------------------------------------------------------ not to allow any third party to use this motor car without the prior approval of the bailer;-- to pay on time all costs arising from the gratuitous use of the motor car described above, namely with regard to fuel consumption, spare parts, any possible repairs resulting from traffic accidents, facultative insurance charges, fees, taxes, fines, etc., including any possible damage to the car by the bailee;-------------------------------------------------------------------------------------------- to return the motor car to the owner upon completion of the time period agreed upon through this document.----------------------------------------------------------------------------------------The undersigned bailee ORBAN JAKAB-NORBERT, I have taken over for gratuitous use the motor car described above, for the period and in the conditions of this agreement.--------The undersigned Hoffmann Edith, I declare that, in virtue of this bailment agreement, the bailee Orban Jakab-Norbert will represent me in the relation with insurance companies, with automobile repair shops, as well as in the relations with any other natural or legal persons, being allowed to fulfill all formalities required in order to defend my interests regarding the motor car which is the object of this bailment agreement.------------------------------------------------------------We, the contracting parties, agree that in accordance with the provisions of Article 2156 of the Civil Code, this agreement may be unilaterally terminated by the bailer, before the expiration of the term for which it was concluded, when she herself has an urgent and unforeseen need of the property, or when the bailee has violated his contractual obligations.------------------------------We, the undersigned parties, declare that we have been made aware by the notary public of the provisions of Article 2157 Civil Code, which establish the power of writ of execution of a bailment agreement concluded in authentic form, in terms of the obligation of restitution.---------This agreement may also be terminated by mutual agreement of the parties, with the mutual granting of a preliminary notice of 30 (thirty) calendar days.---------------------------------------------
