Of what does the 1974 Solesmes Graduale consist? The Solesmes 1974 Graduale Romanum is an exact replica — that is, a perfect “xerox copy” — of the 1908 Editio Vaticana Gradual with Solesmes rhythm signs added. The 1908 Solesmes version has entered the public domain. What do you mean by “xerox” copy? We mean “photographically identical.” In other words, rather than re-typesetting the 1908 book in 1974, the publishers simply made a xerox copy. The same is true of the 1961 Solesmes Graduale. (See the following page.) Do you intend to say that absolutely nothing was changed in the 1961 or 1974 editions? Yes, that is correct. Not a single ictus, episema, or notehead was moved, altered, or modified. The 1974 edition is a precise photographic replica, a xerox copy. (See the following page.) [Strictly speaking, the ictus is irrelevant because the ictus can’t be copyrighted — cf. Sacred Music, Fall 2007.] Surely some content was added in 1974, right? The content is identical to the 1908 (public domain) version. It has been rearranged, but it has not been re-typset. It is true that some (textual) information was added, and this text was taken from the 1970 Vatican Press Ordo Cantus Missae. The Praenotanda was also taken verbatim from the Vatican Press Ordo Cantus Missae. The Ordo Cantus Missae is the property of the entire Church and can be shared freely. A handful of chants were added to the 1974 Gradual, but these were also taken directly from the Ordo Cantus Missae. An example of this would be Alleluia: Disposui testamentum. A few minor changes were made (asterisks removed, “j” changed to “i,” and so forth) but none are of any consequence from a legal perspective. May a publisher add copyright status to a replica of a 1908 public domain work? No. We are unaware of any country wherein an identical copy of a 1908 public domain work can be copyrighted. Many publishers place a copyright notice in the front material, but this has no legal standing and may even be considered “looting the public domain” (a misdemeanor in the United States of America). Does this also mean the Solesmes Gregorian Missal (©2012) is public domain? Not exactly. The music contained therein is certainly public domain, but the 2012 Gregorian Missal contains certain “uniquely copyrightable” layouts, fonts, and design elements.
